TRACY LUJAN protects the interests of her clients. Whether a business is faced with the need for bankruptcy or other debt workout, has a contract enforcement issue, or is experiencing an employment-related issue, Tracy is extremely effective at solving complicated business disputes and simultaneously educating and informing her client of the process and timeline.
A large part of Tracy’s practice includes protecting businesses from employment-related litigation. She works with her clients to ensure their business practices are in compliance with state and federal employment laws and advises them on any necessary changes. She drafts and enforces employment, separation, confidentiality, severance and non-compete agreements. She also advises on tricky termination or discipline issues. When disputes do arise, Tracy advocates on behalf of her client concerning discrimination and retaliation, wage and unemployment, non-compete and similar types of claims.
Tracy guides her clients through the intricacies of the bankruptcy process. Starting before a case is ever filed with the bankruptcy court, she works with corporate debtors to organize their business affairs in preparation for filing. This means she advises everyone from senior management to accounting to human resources on processes and required documentation concerning assets and liabilities, income and expenditures, contracts, downsizing plans and bankruptcy reporting. Once the bankruptcy reorganization plan is confirmed, she continues to advise her clients on the implementation of the provisions of the plan. When the client is a creditor or creditor committee, Tracy advises and advocates on their behalf to ensure their rights are protected.
Tracy also assists clients on general litigation matters. As a litigator, she is adept at learning about her clients' businesses and the facts of their particular dispute. From nursing home construction disputes to Medicare bad debt reimbursement to contract enforcement and collections, she applies her litigation skills to her in-depth knowledge of her client and their issues to reach a favorable result.
Tracy has been an attorney at h3gm since 2002. She worked briefly for the firm as a paralegal before she went to law school at the University of Tennessee. After she received her J.D., graduating magna cum laude, she worked at Otten Johnson Robinson Neff & Ragonetti, PC, in Denver, before returning to Nashville and rejoining h3gm.
