NeWire, Inc. v. Southwire Company (Sumner County, Tennessee Chancery Court): H3GM represents NeWire, which owns patent rights internationally to a revolutionary technology known as “flatwire.” Flatwire is flexible, paper-thin wire capable of transmitting everything from data to electricity, is surface-mounted, is not visible after using standard concealing and painting techniques, and is safer than conventional wire products. In 2005, NeWire gave Southwire Company, one of the world’s largest manufacturers and sellers of wire and cable products, an exclusive global license for NeWire’s patented technology. NeWire contends that Southwire has breached the best efforts commitment Southwire made as part of that license agreement, and has retained H3GM to bring this action, which seeks several hundred million dollars in damages.
