Care Foundation of America, Inc. v. National Health Investors, Inc. (United States Bankruptcy Court for the Middle District of Tennessee): H3GM represented National Health Investors, Inc. (NYSE: NHI), a healthcare REIT, in an adversary proceeding in which bankruptcy debtor CFA asserted various claims arising from NHI’s sale of six Florida nursing homes to CFA. The case was complex and involved several expert witnesses; discovery, which took place on a fast-track, included voluminous document production and over 30 depositions. We obtained for our client a settlement in which NHI re-acquired the homes at a favorable price, and CFA paid the full balance due under its purchase price note, just as the trial began.
